Please be advised that the Summary Notice and Gift Card were mailed to those individuals whose identification information exists at The Golf Mart or Roger Dunn Golf Shops retail stores in California, and was received and/or entered at some time from June 10, 2006 to the present. There is pending in the San Diego County Superior Court a class action entitled Eric Flores v. Worldwide Golf Enterprises, Inc., et al, Civil Action No. 37-2008-0085406-CU-BT-CTL. A proposed settlement of this class action has been reached that will affect class members’ legal rights.

The Golf Mart and Roger Dunn Golf Shops deny and dispute the Eric Flores v. Worldwide Golf Enterprises, Inc., et al, Civil Action, deny any wrongdoing and any liability whatsoever, and believe the action is without merit. No court or other entity has made any judgment or other determination of any liability or a propriety of any claims asserted.

The Golf Mart and Roger Dunn Golf Shops deny all allegations of wrongdoing and contend that the information entered in their customer database was requested lawfully, was never sold or provided to any third party, and was obtained and used only for lawful business purposes. However, to avoid the time, cost and rigors of continued formal litigation, The Golf Mart and Roger Dunn Golf Shops have agreed to settle the Action on the terms summarized in this Notice.

As part of a proposed settlement, class members may use the $15.00 Gift Card at The Golf Mart or Roger Dunn Golf Shops retail stores in California. Gift Cards are valid for ninety (90) days after issuance and no minimum purchase is required.

You can obtain a full notice of the proposed settlement by clicking on Case Documents above. Class members must act on or before October 14, 2011 to request to be excluded from the settlement, or object to the proposed settlement. If you do not request to be excluded from the settlement before October 14, 2011, you will be deemed to have released all claims relating to this case, as described in the full notice.

To request to be excluded from the settlement, you must return the Gift Card you received along with your request for exclusion, to the Settlement Administrator at:
