The Notice pertains to the settlement of a class action lawsuit entitled Hazel Walsh, et al. v. Kindred Healthcare, Inc., et al., case number 3:11-CV-00050-JSW, in United States District Court, Northern District of California, San Francisco Division (the "Lawsuit"). The Settlement Class Members include all persons who resided in one or more of the following facilities between November 23, 2006 and April 15, 2013 (the "Resident Class"), or, if such a resident is now deceased, his or her heir or legal successor-in-interest (the "Successor Class Members").

The settlement also covers all persons who resided in Kindred Healthcare Center of Orange or Alta Vista Healthcare & Wellness Centre from November 23, 2006 through September 30, 2009. The Lawsuit was filed against the above-referenced Facilities and Kindred Healthcare, Inc., Kindred Healthcare Operating, Inc., California Nursing Centers, LLC, Kindred Nursing Centers West, LLC, and Hillhaven-MSC Partnership (collectively, "Defendants").

WHAT IS THE LAWSUIT ABOUT?

Plaintiffs allege that Defendants failed to meet California's minimum and adequate nurse staffing requirements during the above times (defined, "Settlement Class Period"). Defendants deny these allegations. After multiple mediation sessions the parties agreed to settle the Lawsuit. The Court preliminarily approved the settlement and the Notice.
